Austin Attorney for R-1 Visas: Temporary, Non-Immigrant Religious Workers

What is an R-1 Visa?

R-1 visa classification allows religious workers to come to the United States on a temporary basis to be employed at least part time by a legitimate nonprofit religious organization in the United States in order to work solely as a minister, in a religious vocation, or in a religious occupation.

R-1 Eligibility and Application

R-1 nonimmigrant classification eligibility is for:

  • Members of a religious denomination with a bona fide, non-profit religious organization in the United States for at least two years before filing the petition;
  • Members who will be employed by a non-profit religious organization in the United States;
  • Members who will be employed by a religious organization that is legally tax-exempt, or a member who will be employed by a non-profit religious organization that is associated with a religious denomination in the United States; and
  • Members who will be employed solely as a minister or in another religious occupation averaging at least 20 hours of work per week, employed by a bona fide nonprofit religious organization in the United States, or a bona fide organization that is affiliated with the religious denomination in the United States.

After having completed and submitted Form I-29 for nonimmigrant religious worker classification the applicant receives confirming of receipt of the petition and may be deemed necessary for an interview or site visit at the applicant’s headquarters location, followed by a notice of decision on classification status.
